Terms of Service — Elvissa

Welcome to Elvissa. These Terms of Service govern your use of our website and your purchase of products from us.

By accessing our website or placing an order, you agree to be bound by these Terms of Service. Please read them carefully before placing an order.

These Terms are intended to comply with applicable UK consumer protection legislation. Nothing in these Terms is intended to remove or restrict any statutory rights you may have as a consumer.

For the purposes of these Terms, “Elvissa”, “we”, “us” or “our” refers to the business operating the Elvissa website.

“Customer”, “you” or “your” refers to any person purchasing products from Elvissa.

2. Products

We make reasonable efforts to ensure that product descriptions, images, specifications and other information displayed on our website are accurate and up to date.

However, images are provided for illustrative purposes and there may be minor differences in colour, packaging, labelling or appearance.

Such differences will not affect your statutory rights where the goods do not conform to the contract.

Under UK consumer law, goods supplied to consumers must generally be as described, of satisfactory quality and fit for purpose. 

3. Our Dropshipping Business Model

Elvissa operates, in whole or in part, using a dropshipping and third-party fulfilment model.

This means that products purchased through Elvissa may be sourced, stored, packed and/or dispatched by independent third-party suppliers, manufacturers, wholesalers, fulfilment centres or logistics providers selected by Elvissa.

Supplier Selection

Elvissa reserves the right to select, change or replace suppliers, manufacturers, fulfilment centres and logistics providers at its discretion.

We may source the same or similar product from different suppliers depending on factors such as:

  • Product availability
  • Stock levels
  • Delivery location
  • Delivery times
  • Supplier performance
  • Product specifications
  • Pricing
  • Shipping arrangements
  • Quality-control considerations

Customers do not have the right to select Elvissa’s supplier or require Elvissa to purchase a product from a particular supplier.

Supplier Confidentiality

Our supplier relationships, supplier identities, wholesale prices, sourcing arrangements, fulfilment arrangements and other commercial information are confidential business information.

Accordingly, Elvissa is not required to disclose the identity, contact details, wholesale pricing or contractual arrangements of its suppliers to customers, except where disclosure is required by law or a competent authority.

This does not affect your statutory consumer rights or Elvissa’s legal responsibilities regarding products purchased from us.

In other words, you are purchasing the product from Elvissa, not entering into a separate retail contract with our supplier.

4. Our Responsibility for Products

Although we may use third-party suppliers or fulfilment providers, Elvissa remains responsible to the customer for fulfilling the contract between Elvissa and the customer, subject to applicable law.

Using a third-party supplier does not remove or reduce any mandatory consumer rights that apply to your purchase.

We cannot use our dropshipping arrangements as a reason to refuse a legitimate claim relating to faulty, defective, misdescribed or otherwise non-conforming goods.

UK guidance specifically states that businesses cannot use contract terms to avoid responsibility for faulty goods or goods that are not as described. 

5. Placing an Order

When you place an order through our website, you are making an offer to purchase the selected products.

After receiving your order, we may send an order confirmation acknowledging that we have received your order.

An order confirmation does not necessarily mean that the order has been accepted.

We reserve the right to decline or cancel an order where, for example:

  • The product is unavailable
  • There is an obvious pricing or listing error
  • We suspect fraudulent activity
  • We are unable to fulfil the order
  • Delivery to the requested destination is unavailable
  • We reasonably believe the order has been placed in breach of these Terms

If we cancel an order after payment has been taken, we will provide an appropriate refund.

6. Pricing

All prices displayed on our website are stated in GBP (£) unless otherwise specified.

Where applicable, prices will include VAT and other mandatory charges required by law.

Any applicable delivery charges will be displayed before you complete your purchase.

Online sellers must provide consumers with information such as the trader’s identity, product description, total price and delivery arrangements before the order is placed. 

7. Payment

We accept the payment methods displayed at checkout.

You confirm that:

  • You are authorised to use the selected payment method; and

We will not use our third-party suppliers or fulfilment providers as a blanket excuse for failing to comply with our legal obligations.

9. International Suppliers and Fulfilment

Because Elvissa uses dropshipping and third-party fulfilment, an order may sometimes be dispatched from a location outside the UK.

Where this is relevant to the customer’s purchase, Elvissa will provide legally required information concerning delivery, charges and other material matters.

Customers should not assume that the warehouse or fulfilment location is necessarily the same as Elvissa’s business address.

10. Returns and Refunds

Our Refund & Returns Policy forms part of these Terms of Service.

Where applicable, customers purchasing online have statutory cancellation rights under UK consumer law.

Nothing in these Terms removes or restricts statutory rights relating to faulty, defective, misdescribed or otherwise non-conforming products.

11. Faulty, Damaged or Incorrect Products

If you receive a product that is faulty, damaged, defective, incorrectly supplied or not as described, please contact us as soon as reasonably possible.

We may request photographs, videos or other reasonable information to help us investigate the issue.

Where appropriate, we will provide the remedy required by applicable UK consumer law.

Your statutory rights are not affected by this process.

12. Product Safety

We expect products supplied through Elvissa to comply with applicable product-safety requirements.

Where a safety issue, recall or other significant product concern comes to our attention, we may take appropriate action, which may include contacting affected customers, suspending sales or arranging returns or refunds.

  • Any other liability that cannot legally be excluded or limited.

Any limitation of liability applicable to consumers will only apply to the extent permitted by UK law.

This is important because UK consumer terms must be fair and transparent, and businesses cannot simply contract out of mandatory consumer rights. 

18. Events Outside Our Reasonable Control

Elvissa will not be responsible for delays caused by circumstances genuinely outside our reasonable control, such as:

  • Natural disasters;
  • War or civil unrest;
  • Government action;
  • Strikes or major transport disruption;
  • Serious courier disruption;
  • Significant supply-chain disruption;
  • Cybersecurity incidents affecting third-party infrastructure; or
  • Other events that could not reasonably have been prevented.

This clause does not remove any mandatory rights or remedies available to consumers under UK law.

19. Changes to These Terms

We may update these Terms from time to time.

The latest version will be published on our website with the applicable “Last Updated” date.

Changes will not retrospectively remove rights that you have already acquired under a contract.

Where you purchase goods as a consumer, applicable UK law may give you rights relating to quality, description, fitness for purpose, cancellation, refunds, repairs, replacements and other remedies.

Any term that conflicts with a mandatory consumer right will be interpreted or disregarded to the extent necessary to comply with applicable law.

UK government guidance confirms that consumer contracts must be fair and transparent and that businesses cannot enforce unfair terms.
